Apple loses suit against bloggers
Apple had argued that those who leaked confidential reports about companies were not doing news reporting
Apple was dealt with a blow in the case against bloggers when a San Jose califronia appeals court rejected their plea against people who released confidential trade secrets on the Net. The lower court ruling had said that Apple was entitled to know the sources of the posted company secrets.
The judges have found that the First Amendment applies to both online and print journalists and subpoenas issued to Internet Service Providers (ISPs) by Apple to get e-mail records and other materials are unenforceable.
The judgement goes, "We can think of no workable test or principle that would distinguish ‘legitimate’ news from ‘illegitimate’ news. Any attempt by courts to draw such a distinction would imperil a fundamental purpose of the First Amendment.”
It also said that since the websites are protected by the California shield law, it can defend the confidentiality of the writers. Apple had argued that those who leaked confidential reports about companies were not doing news reporting and they were violating copyrights. Apple has not responded to the judgement till now.
The judgement is said to have taken a huge impact on the bloggers and the blogging community, which has been gaining popularity over the years as a communication forum to express one's views and expressions.
